Patient Terms and Conditions

  1. By using any services provided by us, you agree that you are consenting to the below Terms and Conditions, our website Terms of Use that appear at our website www.monivearoad.com.au, and to the Privacy Policy that appears at that website.
  2. You also agree to abide by the terms and conditions of any platforms (such as Shopify) and payment platform providers we utilise, as they are updated from time to time.
  3. You agree that any medication you obtain will be used only by you, and in accordance with the instructions from your prescriber.
  4. You must not use any other cannabis products other than those prescribed for you, and you must only have one cannabis prescriber at any one time.
  5. You must not use any illicit or illegal substances while consuming medicinal cannabis. Doing so may pose a significant risk to your health that may be even greater than that posed by any illicit or illegal substance on its own.
  6. You acknowledge that there are risks in consuming prescribed medication, including medicinal cannabis.
  7. The long-term effects of medicinal cannabis are unknown and most forms of cannabis have not been approved by the Therapeutic Goods Administration for inclusion on the Therapeutic Goods Register.
  8. The potential known risks and complications may include changes in level of sedation, lethargy, fatigue, dry mouth, nausea, vomiting, diarrhea, drowsiness, dizziness, disorientation, agitation, balance problems, changes in memory, paranoid delusions or hallucinations.
  9. If you encounter any significant side-effects, please immediately cease using the product and contact your prescribing health professional.
  10. We expect you to keep a log of your usage of cannabis, including to monitor dosage, changes to your symptoms, and any more side-effects.
  11. Cannabis is not recommended during pregnancy or breast-feeding. If you become pregnant, please immediately inform your prescribing health professional and obtain their advice as to your care. You should not continue to use cannabis without your prescribing health professional’s confirmation that it is safe.
  12. There may also be risks in the administration of certain medications. For flower products, at this stage we understand that the safest way to consume those products is through vaporisation. You should not smoke a flower product.
  13. The long-term health effects of vaporisation are currently unknown, and it is expected that there may be some risks involved with this (although those risks are likely to be lower than the risks posed by smoking the product). These may include an increased risk of emphysema or cancer compared to if you did not take the product at all.
  14. If you have any questions at all in respect of any risks involved with this medication, please let us know, or speak to your prescribing practitioner.
  1. If you have an adverse reaction to medications, please immediately contact 000 and obtain emergency care.
  2. We are not an emergency care service and in an emergency you must take whatever steps are necessary to obtain medical care as a priority.
  1. In Australia, the laws in relation to driving and medicinal cannabis are different in each state and territory. You should never drive when adversely under the influence of a drug. It may also be a criminal offence for you to drive after using medicinal cannabis even if you do not feel that you are under the influence. We strongly recommend that you seek local legal advice in your state or territory as to local laws.
  2. You must not use or operate heavy machinery if you have THC in your system, or if you feel under the influence or adversely affected in any way by any medicine you may be taking, including medicinal cannabis. Doing so is likely to be illegal, and could pose a risk to you or others.
  3. If you need to travel inside Australia with your medication, we recommend that you ensure that you have evidence available to demonstrate that the medication has been prescribed to you.
  4. If you’re planning to travel overseas, we recommend contacting your airline directly and consulting the embassy or consulate of your destination country for the most up-to-date guidance on travelling with your medication. Regulations vary between countries, and it’s important to ensure compliance with both airline policies and international laws. Travelling internationally with any form of cannabis is at your own risk, and you should exercise significant caution in doing so.
  5. Possession and importation of cannabis, even in very small amounts, is a serious criminal offence in some countries, and the fact that it is a prescription is unlikely to be sufficient in many cases for you to avoid prosecution.
  6. In some countries, possession and importation of cannabis can result in substantial jail time or even the possibility of execution.
  1. We are an online-only service and do not provide an in-person pick-up service.
  2. You acknowledge that your medication will be sent to you using a third party service, such as Australia Post, and that although we will seek to minimise the risk of your medication being misdelivered, misdeliveries do occur.
  3. Where misdeliveries occur, you agree to inform us as soon as possible of that fact. Australia Post typically will not investigate missing parcels until a period of time has passed – please contact us to discuss this, and so that we can determine what we may be able to do to assist in that interim period.
  4. We will do what we can to help in that circumstance, but sometimes we may be constrained in what we are able to do.
  5. You may be charged a fee for postage and the fulfilment of orders.
  6. Our fees may change from time to time, but we will inform you of those fees when you place any order from us.
  7. We only accept card payments; we do not accept cash, or other forms of payment such as cryptocurrencies.
  8. If you have any questions about our fees, please contact us.
  1. In general, where you need a new or different product, you will need to speak with your prescribing practitioner to obtain that.
  1. Monivea Road does not tolerate any inappropriate behaviour, including (but not limited to):

  1. If we do terminate care, we will take whatever steps are necessary and appropriate according to reasonable professional standards, and/or required by law, with respect to any remaining prescriptions we currently hold for you.
  2. In some cases, this may require that you see your treating practitioner for a further prescription, as in some cases (for example, in NSW) the transfer of prescriptions may not be permitted.
  1. You acknowledge that a breach of these terms and conditions may result in Monivea Road ceasing to provide care to you.
  2. If a law permits liability to be limited but not excluded, our total liability is limited to the maximum extent possible.
  3. If any parts of these Terms of Conditions are deemed void or unenforceable then that provision may be severed from these Terms of Use.
  4. These Terms of Conditions are governed by and construed in accordance with the laws of Queensland, and you agree that the appropriate jurisdiction for any litigation or dispute is Queensland.
